Privacy Policy

Sterling Collective is committed to protecting the privacy of visitors to our website and the clients and prospects who interact with us. This Privacy Policy explains what personal information we collect, how we use it, with whom we share it, and the rights you have in connection with that information.

This Privacy Policy applies to personal information collected through our website at sterling-collective.com (the “Site”) and through our client portal. It does not apply to personal information we collect in other contexts, which may be governed by separate agreements between you and Sterling Collective.

1. Who We Are

“Sterling Collective” is the trade name under which the following affiliated operating entities do business. Each entity is responsible for the personal information it collects and processes, as described in this Privacy Policy and as summarized below:

  • Dahlgren Duck & Associates, LLC, a Texas limited liability company, doing business as Sterling Collective. Responsible for clients located in the United States (other than California).
  • SterCal Logistics, LLC, doing business as Sterling Collective. Responsible for clients located in California.
  • Dahlgren Duck UK Limited (company number 11496474), a company registered in England and Wales, doing business as Sterling Collective. Responsible for clients located outside the United States.
  • Sterling Collective Group, LLC, the parent holding company of the foregoing entities.

We refer to these entities collectively as “we,” “us,” “our,” or “Sterling Collective.” These entities share common ownership, systems, and staff, and may share personal information among themselves for the purposes described in this Privacy Policy. Where applicable law requires that we identify a specific entity as a “business,” “controller,” or equivalent, we do so in the jurisdiction-specific sections below.

2. Information We Collect

We collect the following categories of personal information:

a. Information you provide to us

We collect information you provide when you contact us, inquire about our services, engage us as a client, or use our client portal. This may include your name, business affiliation, email address, telephone number, mailing or shipping address, the nature of your inquiry or project, and any other information you choose to provide. For clients, we may also collect project specifications, design preferences, delivery addresses (which may include private residences, yachts, or aircraft), and business contact information for your representatives.

b. Information collected automatically

When you visit the Site, we and our service providers automatically collect certain information about your device and browsing activity, including your IP address, browser type and version, operating system, referring website, pages viewed, time and date of your visit, and similar technical information. We collect this information using cookies and similar technologies, as described in Section 5 below.

c. Information from third parties

We may receive information about you from third parties, including referrals, publicly available sources, and service providers we engage to help us operate our business.

3. How We Use Personal Information

We use personal information for the following purposes:

  • To respond to inquiries and communicate with you;
  • To provide, administer, and deliver our services, including procuring, sourcing, and delivering products on behalf of our clients;
  • To operate and secure the Site and the client portal;
  • To send you information about our services, including newsletters and marketing communications where permitted;
  • To analyze how the Site is used and to improve our services;
  • To comply with legal obligations, respond to legal process, and enforce our agreements; and
  • For other purposes disclosed to you at the time of collection or with your consent.

4. How We Share Personal Information

We may share personal information with the following categories of recipients:

  • Affiliates. We share personal information among the Sterling Collective entities identified in Section 1 for the purposes described in this Privacy Policy.
  • Service providers. We engage third parties to provide services on our behalf, including website hosting, email and productivity software, customer relationship management, payment processing, cloud storage, analytics, and marketing platforms. These providers may access personal information only to perform services for us and are contractually required to protect it.
  • Vendors and partners. To fulfill our services to clients, we may share limited information, such as shipping addresses and project specifications, with suppliers, logistics providers, designers, and other parties involved in delivering products and services.
  • Legal and regulatory recipients. We may disclose personal information in response to a subpoena, court order, or other legal process, or where we reasonably believe disclosure is necessary to comply with the law, protect our rights or the rights of others, or prevent fraud or illegal activity.
  • Business transfers. If we are involved in a merger, acquisition, sale of assets, or similar transaction, personal information may be transferred to the successor or acquiring party.

We do not sell personal information for monetary consideration. For information about how California law treats certain disclosures as a “sale” or “sharing,” see Section 8.

5. Cookies and Similar Technologies

We use cookies and similar technologies to operate the Site, remember your preferences, analyze usage, and (where you consent) deliver marketing and advertising. Cookies are small data files stored on your device when you visit a website.

We use the following categories of cookies and trackers:

  • Strictly necessary cookies that are required for the Site to function and for you to access the client portal. These cookies cannot be disabled.
  • Analytics cookies that help us understand how visitors use the Site, including through services such as Google Analytics.
  • Marketing and advertising cookies that allow us and our advertising partners to deliver relevant advertising on other websites, including through services such as Meta and LinkedIn.

When you first visit the Site, we present a cookie consent banner that allows you to accept or reject non-essential cookies. You can change your preferences at any time by clicking the cookie settings link in the footer of the Site. You can also configure your browser to refuse cookies, although certain features of the Site may not function properly if you do.

We recognize and honor the Global Privacy Control (GPC) signal as an opt-out of the sale or sharing of personal information where required by applicable law.

6. How Long We Retain Personal Information

We retain personal information for as long as necessary to fulfill the purposes described in this Privacy Policy, unless a longer retention period is required or permitted by law. Our general retention periods are:

  • Client information (including project records): for the duration of the client relationship and for seven (7) years thereafter;
  • Prospect and contact form information: for three (3) years after collection, or longer if you continue to engage with us; and
  • Website analytics data: in accordance with the settings we maintain with our analytics service providers.

We may retain information for longer periods when necessary to comply with legal, tax, accounting, or regulatory obligations, to resolve disputes, or to enforce our agreements.

7. Information Security

We maintain reasonable administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, use, disclosure, alteration, or destruction. However, no method of transmission over the internet or electronic storage is completely secure, and we cannot guarantee absolute security.

8. Information for California Residents

This section provides additional information required by the California Consumer Privacy Act, as amended by the California Privacy Rights Act (collectively, the “CCPA”), for California residents. For purposes of the CCPA, SterCal Logistics, LLC is the “business” with respect to personal information of California residents. The other Sterling Collective entities may also process California residents’ personal information as service providers or affiliates.

Categories of personal information collected

In the preceding twelve (12) months, we have collected the following categories of personal information about California residents:

  • Identifiers (name, email address, postal address, telephone number, IP address, and similar identifiers);
  • Customer records information (contact information, business affiliation, and similar information);
  • Commercial information (records of services purchased or inquired about);
  • Internet or other electronic network activity information (browsing and interaction with the Site);
  • Geolocation data (general location derived from IP address);
  • Professional or employment-related information (for business contacts); and
  • Inferences drawn from the foregoing to create a profile reflecting preferences and characteristics.

We do not knowingly collect or process “sensitive personal information” as defined by the CCPA for purposes of inferring characteristics about you. We do not knowingly collect personal information of minors under 16.

Sources, purposes, and recipients

The sources from which we collect personal information, the business and commercial purposes for which we use it, and the categories of third parties with whom we share it are described in Sections 2, 3, and 4 of this Privacy Policy.

Sale and sharing of personal information

We do not sell personal information for monetary consideration. We may “share” personal information as that term is defined under the CCPA when we use advertising cookies that allow third parties such as Meta or LinkedIn to engage in cross-context behavioral advertising. You have the right to opt out of such sharing, as described below.

Your California rights

Subject to certain exceptions, California residents have the following rights:

  • The right to know what personal information we have collected about you, including the categories, sources, purposes of collection, and categories of third parties with whom we share it;
  • The right to request a copy of the specific pieces of personal information we have collected about you;
  • The right to request that we delete personal information we have collected from you;
  • The right to request that we correct inaccurate personal information;
  • The right to opt out of the sale or sharing of your personal information; and
  • The right not to be discriminated against for exercising these rights.

To exercise your rights, contact us at privacy@sterling-collective.com or through the “Do Not Sell or Share My Personal Information” link in the Site footer. We will verify your request by confirming information we already have on file about you. You may designate an authorized agent to make a request on your behalf, subject to verification of the agent’s authority. We will respond to verifiable consumer requests within the timeframes required by the CCPA (generally within 45 days, with a possible 45-day extension).

9. Information for Individuals in the United Kingdom and European Economic Area

This section provides additional information required by the UK General Data Protection Regulation (“UK GDPR”) and the EU General Data Protection Regulation (“EU GDPR”) for individuals located in the United Kingdom or European Economic Area.

Dahlgren Duck UK Limited, a company registered in England and Wales with company number 11496474, is the controller of personal information it collects and processes for clients located outside the United States, including clients in the United Kingdom and European Economic Area.

Legal bases for processing

We process personal information on the following legal bases:

  • Contract: where processing is necessary to enter into or perform a contract with you or your organization;
  • Legitimate interests: where processing is necessary for our legitimate interests in operating and promoting our business, responding to inquiries, and maintaining the security of the Site, and those interests are not overridden by your rights;
  • Consent: where you have given consent (for example, for non-essential cookies or for marketing communications); and
  • Legal obligation: where processing is necessary to comply with a legal obligation to which we are subject.

Your rights

Subject to applicable law, you have the right to access, correct, delete, restrict processing of, and port your personal information; to object to processing based on legitimate interests or for direct marketing; and to withdraw consent where processing is based on consent. To exercise these rights, contact us at privacy@sterling-collective.com. We will respond within one month of receipt, subject to a possible extension of up to two additional months for complex requests.

International transfers

Because we operate globally, personal information we collect may be transferred to, stored in, and processed in the United States and other countries whose data protection laws may differ from those of your country of residence. Where we transfer personal information from the United Kingdom or European Economic Area to a country that has not received an adequacy decision from the relevant authority, we rely on appropriate safeguards, such as the UK International Data Transfer Agreement or the EU Standard Contractual Clauses, to protect the information. You may request a copy of the applicable safeguards by contacting us at privacy@sterling-collective.com.

Complaints

If you are located in the United Kingdom, you have the right to lodge a complaint with the Information Commissioner’s Office (ico.org.uk). If you are located in the European Economic Area, you have the right to lodge a complaint with the data protection authority in your country of residence.

10. Children

The Site is not directed to children. We do not knowingly collect personal information from children under the age of 16. If you believe we have collected personal information from a child, please contact us so we can delete it.

11. Changes to this Privacy Policy

We may update this Privacy Policy from time to time. When we do, we will revise the “Effective Date” above and post the updated policy on the Site. For material changes, we will provide additional notice as required by applicable law.
